Montenegro residence through property: what to verify

17 October 2026 6 min Updated 17 October 2026

Does buying property automatically give Montenegro residence?

No. Buying property and receiving a residence permit are separate processes. Official guidance recognizes rights over property as a possible basis for temporary residence, but eligibility depends on current law and the individual application. Before a deposit, ask MUP or a Montenegrin lawyer whether the property and your circumstances qualify. Ownership does not guarantee a permit, employment rights, permanent residence or citizenship.

She works daily with notaries, the cadastre and Montenegrin mortgage banks, and personally oversees every transaction the agency handles.

If relocation is the reason for buying, check immigration eligibility before choosing an apartment. This guide separates ownership from residence and sets out a verification sequence without promising an outcome.

Current legislation matters more than an old announcement

The Government’s 2025 announcement about a €200,000 threshold described draft amendments, not proof of the final current requirements. The Official Gazette records amendments to the Law on Foreigners in No. 3/2026, effective from 17 January 2026. This guide therefore does not claim a specific current monetary threshold: check the enacted text, any later amendments and transitional provisions before applying.

This guide was checked on 17 October 2026 against official general guidance and the amendment record; case-specific eligibility still needs confirmation. Do not pay a deposit solely on the basis of an online article or another buyer’s earlier experience.

Check the residence basis and property before purchase

Show a lawyer the current cadastral extract, registered property type, owner and any co-ownership. Do not assume a plot, commercial premises or every ownership share is treated like an apartment. Immigration eligibility and clear title are different questions; both need checking.

Arrange this review before a binding contract. If residence is essential to your purchase, ask your lawyer whether lawful contractual protections can address that condition. An agency can help with property documents but cannot decide residence applications.

Which documents should you confirm with MUP?

Request a current checklist from the competent MUP office. The table below is a set of verification topics, not a definitive mandatory document list. Required evidence, validity periods, translation and certification depend on applicable requirements and your case.

Pre-application verification topics — the authority provides the final checklist.
TopicWhat to ask
Identity and entryPassport validity, lawful stay and arrival registration
OwnershipQualifying property, ownership share and current cadastral proof
Funds and insuranceAccepted evidence and required coverage period
Foreign documentsIssue dates, translation and legalization where required
FamilySeparate applications and relationship evidence under current rules

Application and renewal are separate checks

Confirm where and when to apply, fees, appointment arrangements and proof of filing. Do not assume purchasing extends a permitted tourist stay or that filing alone grants every right. Ask MUP to explain your status while the application is pending.

For renewal, verify the deadline before expiry and whether the qualifying basis continues. Keep documents and tell your lawyer about changes in ownership, address or family circumstances. This guide promises neither a fixed processing time nor automatic renewal.

Residence is not citizenship or an employment promise

Temporary residence, work authorization, permanent residence and citizenship have different requirements. Obtain separate legal advice for each goal. Family members do not automatically receive permits just because you bought an apartment.

Once the legal basis is confirmed, compare homes for everyday living: layout, building costs, transport and access to school or work. Ask Trust for property documents and a viewing; leave the immigration decision to the competent authority.

Bottom line: key takeaways

  • Purchase and temporary residence are separate processes.
  • An old draft announcement must not be presented as current law.
  • Check the property’s eligibility before a deposit.
  • The competent authority confirms the final document list.
  • Ownership does not guarantee work rights, permanent residence or citizenship.
